1. Acceptance of Terms

By accessing or using the MapRank website at https://maprank.ca (the "Site") or any services provided by MapRank ("we", "our", "us"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site or our services.

2. Description of Services

MapRank provides Google review automation services for home service businesses in Calgary, Alberta, and across Canada. Our services include automated review request campaigns via SMS and email, AI-generated review responses, Google Maps ranking tools, and related marketing services (collectively, the "Services").

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent. By using our Services, you represent that you meet these requirements.

4. Acceptable Use

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services to solicit, generate, or post fake, incentivized, or misleading reviews in violation of Google's review policies or any applicable law
• Use the Services to harass, spam, or send unsolicited communications to individuals who have not consented to receive them
• Attempt to gain unauthorized access to our systems, servers, or databases
• Transmit any viruses, malware, or other harmful code
• Scrape, copy, or reproduce content from the Site without our written permission
• Use the Services in any way that violates applicable Canadian federal or provincial laws

5. Google Policy Compliance

MapRank's services are designed to help businesses collect authentic reviews from real customers in compliance with Google's review policies. You are solely responsible for ensuring that your use of our Services complies with Google's Terms of Service and review policies. MapRank does not guarantee any specific Google Maps ranking outcomes and is not affiliated with Google LLC.

6. Account and Demo Requests

When you submit a demo request or sign up for our Services, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under your account. Notify us immediately at hi@maprank.ca if you suspect any unauthorized use.

7. Subscription, Billing, and Cancellation

Paid plans are billed monthly or annually in Canadian dollars (CAD) as selected at sign-up. A 14-day free trial is available with no credit card required. After the trial period, continued use of the Services requires a paid subscription. You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months unless required by applicable law.

8. Free Trial

The 14-day free trial is available to new customers only, one per business. We reserve the right to terminate or modify the free trial offer at any time. At the end of the trial, your account will be paused unless you select a paid plan.

9. Intellectual Property

All content on the Site — including text, graphics, logos, and software — is owned by or licensed to MapRank and is protected by Canadian and international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our express written permission.

10. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MapRank and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MapRank and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Services

Our Services may integrate with or link to third-party platforms (including Google, Jobber, Housecall Pro, and others). We are not responsible for the availability, accuracy, or practices of these third-party services. Use of any third-party service is governed by that party's own terms and policies.

14. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Calgary, Alberta.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
